KAILUA-KONA — A 48-year-old man initially arrested, but released, during a marijuana bust at a Kona Palisades home last week has since been indicted by a grand jury.
KAILUA-KONA — A 48-year-old man initially arrested, but released, during a marijuana bust at a Kona Palisades home last week has since been indicted by a grand jury.
The indictment against Robert Patrick Kirkhill was filed in 3rd Circuit Court on Tuesday. He is facing charges of commercial promotion of marijuana and numerous drug charges. A bench warrant for his arrest was issued Wednesday with bail set at $30,000.
The Kona Vice Section with Hawaii Police discovered 368 marijuana plants during a search warrant on the Palisades home on Aug. 6 where Kirkhill resides.
The search at the residence, on the 73-1000 block of Kaiminani Drive, also yielded 30 pounds of dried marijuana, a digital scale, Ziploc bags with marijuana inside and other items.
According to the indictment, it states Kirkhill possessed one or more preparations, compounds, mixtures or substances of an aggregate weight of one-eighth ounce or more, “containing one or more of the harmful drugs or one or more of the marijuana concentrates.”
The 48-year-old was also found in possession of 25 or more capsules of tablets containing one or more of the harmful drugs or one or more of the marijuana concentrates as well as possession of the drug alazopram.
Police recovered $9,000 in cash at the scene as well as an unregistered firearm.
Kirkhill is facing charges of two counts of first-degree promotion of marijuana, prohibited acts related to drug paraphernalia, second-degree promotion of a harmful drug, fourth-degree promotion of a harmful drug and third-degree promotion of a harmful drug.
Kirkhill was also found in possession of a Ruger .357 Magnum. The 48-year-old is also facing charges related to the unregistered firearm.
Meanwhile medical cannabis is stalled under a mound of paper.
Only way people in power fight this hard, this long is if they have a huge financial self-interest in keeping it illegal. My once-naive hopes that they had more altruistic motivations went out the door a long time ago (even though I used to smoke back then, haha). With age comes disillusionment…
He should of. Bought a plane ticket to Colorado with his $9000 cash. He could of just walked in the store and bought marijuana. Marijuana cookies marijuana oils, hash brownies. but no he wants to live in Hawaii and get thrown in jail for spreading the green aloha.
Don’t confuse this guy with your average medical marijuana user. He had 38 pounds – 608 ounces – of dried weed and hundreds of plants. If this is true (innocent until proven guilty), he is a major dealer of weed. He had other drugs in his possession, as well as an unregistered .357. He is not the poster boy for compassionate or medicinal use of marijuana. He is the very reason why we need to get the dispensaries going: get the criminal and dangerous elements out of the pot business.

This is a cash crop for the aging hippies that live up there.

Does the County have a system in place to provide medicine NOW for the 6 patients who were legally having their prescription grown and processed by Mr. Kirkhill ? Doesn’t Every licensed medical M.J. user pay a yearly fee to the D.O.H. for the ability to legally grow (or have grown for them) , stockpile, and Use ? DOH does not provide medicine or any resources to assist a patient to procure medicine and all the dispensaries seem to be able to do is provide the $funding for our “green harvest” search and seizures . Good way to eliminate any competition , legal or otherwise.
