A 32-year-old man accused of shooting a neighbor to death in a Volcano subdivision last week will receive a mental examination.
Hilo District Judge Kanani Laubach on Monday ordered the examination of Daris Pacheco by three mental health professionals. The examination was requested by Pacheco’s court-appointed attorney, Stanton Oshiro, with no objection by prosecutors.
Pacheco is charged with second-degree murder for allegedly shooting 59-year-old Jay Allen Freeman, a neighbor on Nau Nani Road in Aloha Estates subdivision, on April 26. The midday shooting, on Freeman’s driveway, was described by Deputy Prosecutor Andrew Son as “an execution in daytime.”
Pacheco is also charged with carrying a firearm in the commission of a separate felony, burglary of a dwelling during an emergency, first-degree terroristic threatening, five counts of prohibited possession of a firearm or ammunition, illegally carrying a firearm, methamphetamine and marijuana possession, and possession of drug paraphernalia.
Laubach also granted a motion by Deputy Prosecutor Kevin Hashizaki to keep Pacheco in custody without bail, and ordered Pacheco to return to court on July 13.
