KAILUA-KONA — A Kailua-Kona man accused of sexual assault and kidnapping last June has pleaded no contest.
On Monday, Daniel Jones-Bivings, 41, pleaded no contest to intentionally or knowingly restraining another person with the intent to inflict bodily injury, committing the offense of kidnapping. He made his plea in 3rd Circuit Court in front of Circuit Court Judge Robert D.S. Kim.
The 41-year-old faces a maximum punishment of 10 years imprisonment and a $25,000 fine.
In light of Jones-Bivings’ no contest plea, the prosecutor’s office will drop the remaining charges: felony abuse of family or household member, second-degree assault, first-degree sexual assault and intentionally or knowingly restraining another person with the intent to subject a person to a sexual offense, committing the offense of kidnapping.
Bail conditions have been canceled and Kim has ordered Jones-Bivings to contact Adult Probation Services by today.
Sentencing is set for July 13.
Charges stem from an incident that occurred on June 9. According to police, the Kailua-Kona man assaulted a woman while driving to Honokohau Harbor then outside a residence on Kiwi Street.
