Kona man facing 17 charges allegedly violates bond conditions

KAILUA-KONA — A man with 17 charges and a lowered bail was back in court Wednesday after allegedly violating his bail.

KAILUA-KONA — A man with 17 charges and a lowered bail was back in court Wednesday after allegedly violating his bail.

Michael Phillip Patrakis, 43, Kailua-Kona, is charged with first-degree meth trafficking, first-degree promoting a detrimental drug, two counts of third-degree promotion of a dangerous drug, possession of drug paraphernalia, four counts of first-degree promoting child abuse, two counts of second-degree promoting child abuse, abuse of a family or household member, third-degree sexual assault, kidnapping, second-degree reckless endangerment, first-degree terroristic threatening and use of a computer in the commission of a separate crime.

One of his bond conditions is that he not contact a number of people, including the juveniles who were allegedly victimized. The state said he violated that condition.

“I’ve not contacted any of them, your honor,” Patrakis said.

His attorney challenged the basis of the motion.

“This is based on triple hearsay,” said defense attorney Jason Kwiat. “There is no affidavit based on personal knowledge.”

Sheri Lawson, deputy prosecuting attorney, said there would be supplemental filings that would clarify the issue.

A hearing date was set for Dec. 12.

Lawson asked that the bond be raised to $500,000.

On his initial arrest, Patrakis’ bond was set at $100,000. He placed that bond.

“I’ve been doing everything I need to be doing,” Patrakis told the judge, including attending Narcotics Anonymous, Alcoholics Anonymous and calling in to the Intake Service Center every day.

Bond was set at $300,000.

The judge asked about what residence Patrakis had, which is required material for the bond information.

Patrakis said that he was staying at several different friends’ houses, but has no permanent address.

Patrakis became more agitated as the hearing continued. He continued to try and get the bail lowered, arguing that he was not a flight risk and the other necessities of bail did not apply.

“I respectfully ask you, reduce the bail, please, I’m doing everything I need to do,” he said to the judge.
