A Mountain View man is in jail after police discovered multiple marijuana plants during a search of private property at 11 a.m. Sept. 6.
Puna police were told there was a person trespassing on some undeveloped land. Officers arrived and began to search the area, Maj. Samuel Thomas said.
As police were surveying the area they found a trail, said Thomas. When the officers followed the trailm they found 85 marijuana plants, with James Carl Rusch, 57, beside them.
Officers charged him with commercial promotion of marijuana in the second degree. The charge demands having more than 50 plants, while the first degree version is 100 or more.
He was arrested at the scene.
