A 33-year-old Hilo woman who went ballistic during a hearing to revoke her probation for allegedly failing to complete a court-ordered anger management program is out on bond.
Ashley Mercado-Silva still faces possible revocation of her probation on a 2013 conviction for felony theft, credit card theft and credit card fraud. Her hearing is scheduled for 8:30 a.m. Nov. 19.
According to court records, Hilo Circuit Judge Greg Nakamura ordered her on Oct. 24 to receive a substance abuse assessment and assessment for mental health and anger management, and undergo any recommended treatment.
Mercado-Silva erupted in an expletive-laced tirade during an Oct. 21 hearing when her bail was set at $10,000. Hilo Circuit Judge Glenn Hara ordered sheriff’s deputies to remove her forcibly from the courtroom when she refused to calm down.
The Tribune-Herald reported at the time Mercado-Silva shouted, “Five-thousand dollars bail? Seriously, Stanton?” after her attorney, Stanton Oshiro — who originally requested she be freed on supervised release — countered the prosecution request for $10,000 bail with a $5,000 bail. That occurred after the judge indicated an unwillingness to release Mercado-Silva without bail. The Tribune-Herald reported Mercado-Silva was “apparently upset that her lawyer abandoned his request for her release without bail …”
Oshiro told the Tribune-Herald in a phone call the day after publication Mercado-Silva’s outburst wasn’t directed at him personally, and added the actual reason for his client’s anger was because she thought $10,000 bail was excessive for what she considered a minor violation. He also said Mercado-Silva was misquoted in the story.
The court hearing transcript, obtained by the Tribune-Herald, recorded Mercado-Silva as saying, “I will — f—-n’ post and have one f—-n’ bail? Seriously, Stanton?”
