HONOLULU — Sentencing is set for Wednesday for a retired car dealer convicted of reckless endangering in the 2006 breach of a Kauai dam that killed seven people.
The Honolulu Star-Advertiser reports 88-year-old James Pflueger pleaded no contest to the charge July 18.
His company, Pacific 808 Properties, pleaded no contest to seven counts of manslaughter.
The seven were swept to their deaths when the Ka Loko Dam failed. The breach sent hundreds of millions of gallons of water downstream.
Prosecutors accused Pflueger of causing the dam’s failure by filling in its spillway. His plea deal calls for Pflueger to accept five years of probation.
Prosecutors can ask the judge to impose up to a year in jail, community service and a fine.
Pacific 808 Properties will pay a $350,000 fine.
