The Hawaii Department of Health issued a Notice of Violation and Order against Royal Hawaiian Water Co., Ltd. doing business as Hawaiian Isles Water Company (Hawaiian Isles) and The FRS Company. The two companies were fined for late payments and reports required of beverage distributors under the state’s Deposit Beverage Container Program law, also known as the HI-5 program.
Hawaiian Isles was delinquent for the monthly reporting period of Feb. 1 to 28, and The FRS Company was delinquent for the semi-annual reporting period from Feb. 1 to June 30.
Hawaii Revised Statutes §342G-105 requires beverage distributors to submit monthly or semi-monthly distributor reports and payments to the Hawaii Department of Health no later than the 15th calendar day of the month following the end of the payment period for the previous month.
Both Hawaiian Isles and The FRS Company received multiple written notices reminding them about the reporting requirements prior to being assessed a penalty. The penalty for Hawaiian Isles was $3,960 and the penalty for The FRS Company was $400.
Both Hawaiian Isles and The FRS Company may request a hearing to contest the alleged facts and penalty.
