Planning Director Duane Kanuha issued a letter Sept. 16 to Oceanview Partners LLC and its agent, Bradley Westervelt, notifying them of the complaint, from the Hawaiian Ranchos Road Maintenance Corp. “alleging that you are violating the conditions of (the special permit) by not providing on-site parking for the farmers market, allowing overflow vehicles to park on privately owned roads and operating the farmers market on weekdays.”
Westervelt referred an email request for comment to someone who claimed to be an owner of the swap meet. That person declined to provide his name or comments on the record.
The special permit was first issued in 1987, allowing for commercial development on the property. In 2002, the planning commission amended the permit to expand the uses to include an open storage facility and farmers market.
Hawaiian Ranchos Road Maintenance Corp. filed the formal complaint Aug. 9, after what subdivision residents described s failed attempts to resolve their concerns with swap meet owners. According to the complaint, overflow vehicles are creating a “dangerous road condition” on privately owned road. The complaint said the corporation asked the swap meet owners to hire traffic control for market days, to no avail.
A March letter to the Planning Department said the road maintenance corporation officials did not want to shut down the swap meet, but want it “operated safely with due regard to traffic flow, damage to the roads” and compliance with the permit’s conditions.
Permit conditions allow the planning director to initiate an investigation following a complaint and refer the complaint and investigation to the appropriate planning commission for additional review, Kanuha’s letter said.
“Letters submitted to the Planning Department from (the road maintenance group) indicate that (the swap meet owners) from Ocean View Partners LLC have communicated by email and met with (road maintenance group) representatives regarding heavy traffic and parking problems associated with the farmers market,” Kanuha’s letter said. “However, based on the complaint we recently received it appears that Oceanview Partners LLC has been unable to resolve the complaint.”
A hearing date has not yet been set.
