Editor’s note: This log of individuals sentenced in 3rd Circuit Court is a regular feature of West Hawaii Today and is compiled using court and Hawaii County Police Department records. A deferred acceptance of a plea includes the provision that if all conditions of the sentence are met, the court shall later dismiss the charge against the defendant.
c Jeffery Michael Fuerte, 46, of Kailua-Kona, pleaded guilty May 11 to failure to have a place to keep unloaded firearms other than pistols and revolvers. He received a five-year deferred acceptance of his plea with conditions he pay $755 in fines and fees, and serve 30 days incarceration, with credit for time served and all remaining time suspended.
c Chad Barboza, 34, of Kaneohe, Oahu, pleaded guilty March 15 to attempted second-degree unauthorized entry into a dwelling, third-degree assault and second-degree terroristic threatening. He was sentenced May 14 to five years probation for the attempted unauthorized entry offense and one year for the remaining counts, pay $7,858.79 in fines, fees and restitution, serve six months incarceration, with credit for time served and all but 30 days suspended, and write an apology letter to the victim.
c Margaret Thoman, 43, of Holualoa, pleaded guilty March 8 to first-degree promoting a detrimental drug. He received on May 21 a five-year deferred acceptance of his guilty plea with conditions that he serve 90 days incarceration, with credit for time served and all remaining time suspended, and pay $2,650 in fines and fees.
c Devin L.K. Saragosa-Taoy, 20, of Keaau, pleaded guilty March 29 to two counts second-degree robbery and one count third-degree assault. He was sentenced concurrently May 21 to serve up to five years incarceration for the robbery offenses and one year for the assault offense, with credit for time served. He must also pay $1,971.76 in fees and restitution.
c Ronald Kaliko Jr., 35, of Ocean View, pleaded guilty May 23 to violation of a temporary restraining order. He was sentenced to one year probation with conditions that he serve six months incarceration, with credit for time served and all remaining time suspended, and pay $130 in fees.
c Justin Dusk Harvey, 38, of Kona, pleaded guilty May 23 to third-degree assault. He was sentenced to six months probation with conditions that he serve five days incarceration, with credit for time served and all remaining time suspended, and pay a $30 fee, in addition to an undisclosed amount of restitution.
c Smith K.K. Alani, 24, of Kona, pleaded guilty March 20 to second-degree assault. He was sentenced May 25 to five years probation with conditions that he serve intermittently 285 days in jail, with credit for time served, pay $8,637.85 in fines, fees and restitution and write an apology letter to the victim.
