The Department of Land and Natural Resources is proposing a rule that would require all operators of power-driven vessels in Hawaii to possess a certificate, showing competition of an approved boating course from the state and the National Association of State Boating Law Administrators.
The course would be on the safe use and operation of certain power-driven vessels, as well as a component on Hawaii waters approved by the department. That component would include topics like local ocean safety principles and practices, any rules or laws pertaining to protected species, and power-driven operation in the state, according to the draft.
The proposed rule would apply to boaters of all ages 15 and over, and require those under age 15 to be directly supervised by someone holding a valid certificate. The only people exempt are those who possess a valid license to operate a vessel issued for maritime personnel by the Coast Guard and those who operate a thrill craft in a zone authorized by the state.
DLNR said it will not enforce the rule until two years after its effective date. The agency is seeking comments on its proposal from 5 to 7 p.m. Wednesday at the Big Game Fishing Club at Honokohau Small Boat Harbor in Kailua-Kona.
Those interested in submitting comments may do so either orally or in writing at the hearing. Written statements may be sent up to one week following the hearing and mailed to DLNR Chairman William Aila Jr., 1151 Punchbowl St., Room 130, Honolulu, HI 96813.
The rule can be viewed online at hawaii.gov/dlnr/dbor/bordraftrules.htm or at any small boat harbor from 8 a.m. to 3:30 p.m. Monday through Friday, except holidays. A copy can also be mailed after payment of the required fees for postage and paper upon verbal or written request to DLNR’s Division of Boating and Ocean Recreation, which can be reached by calling 587-0142 or mailing a letter to the division at 333 Queen St., Suite 300, Honolulu, HI 96813.
